Welcome to Nibia! These Terms and Conditions govern your use of the Nibia platform, mobile application, and services. By accessing or using Nibia, you agree to be bound by these Terms.

1. Account Registration and Types

Nibia offers two account types: Family Account for individual households and personal shopping, and Business Account for restaurants, caterers, corporate buyers, and businesses.

To create an account, you must be at least 18 years old, provide accurate information, and comply with all applicable laws. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.

2. Payment Plans

Pay-Now

Immediate payment for goods with delivery within 6 to 24 hours. No additional service fees.

Price-Lock

Lock current prices for up to 30 days with a minimum order value of ₦50,000. Earn Food Points (Nibia) on price-locked orders. Prices locked are guaranteed regardless of market fluctuations.

Pay Small-Small

Spread payments over 1 to 16 weeks or 1 to 4 months. Delivery after subscription period completes. All subscription funds are held in FoodSafe.

Pay-Later

Subject to credit qualification with a maximum loan period of 30 days. Delivery within 24 hours of order approval. Late payments may affect your Nibia credit score.

3. Delivery Terms

Pilot Cities: Same-day or next-day delivery
Other Cities: 3 to 5 working days

Delivery fees are calculated based on total weight (kg), delivery location, and express delivery option if selected. Free delivery is available on select subscription bundles for pilot cities.

You must provide an accurate delivery address and be available to receive delivery. Inspect items upon delivery and report any issues within 24 hours.

4. Food Points (Nibia) Rewards

Earn Food Points through Price-Lock orders, referral program commissions, and promotional campaigns. Food Points can be used as payment for any product and can be combined with Food Money (NGN).

Food Points have no expiration date unless your account is inactive for 12 months. They are non-transferable between accounts and have no cash value.

5. Referral Program

Regular Users: Earn commission on the first three purchases of each referral, paid in Food Points (Nibia).

Pro-Affiliate (Growth Associate): Qualify by referring 100 users with combined purchases of ₦600,000 within one year. Earn commissions on all referral purchases with the option to receive Food Points or cash.

Referrals must be genuine new users. Self-referrals and fraudulent referrals will result in account termination.

6. Credit Scoring System

Your Nibia credit score is based on payment history, completion of payment plans, account age, and order frequency. Higher scores unlock increased Pay-Later limits, extended payment terms, exclusive offers, and priority support.

Late payments and incomplete payment plans negatively affect your score. Defaults may result in account suspension.

7. Cancellation and Refunds

Pay-Now: Cancel within 1 hour for full refund
Price-Lock: Cancel anytime before lock period expires for full refund
Pay Small-Small: Partial refund available (total paid minus commissions distributed)
Pay-Later: Cancel before delivery for full refund

Refunds are processed within 5-10 business days to the original payment method.

8. Product Quality and Returns

We guarantee products meet described specifications with proper storage, appropriate expiration dates, and authenticity from verified sources.

Report issues within 24 hours of delivery including damaged products, incorrect items, missing items, or quality concerns. Contact customer support with order details and photos for resolution.

9. Prohibited Activities

You agree not to violate laws, infringe intellectual property rights, engage in fraudulent activities, create multiple accounts to abuse promotions, share account credentials, or interfere with Platform operations.

10. Limitation of Liability

To the maximum extent permitted by law, our liability is limited to the amount you paid for the specific order. We are not liable for indirect, incidental, or consequential damages or third-party actions.

We strive for 99% uptime but do not guarantee uninterrupted service. We are not liable for service interruptions beyond our control.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting. We will notify you of material changes via email, in-app notifications, or platform announcements.

Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of Nigerian courts.
