These Terms and Conditions ("Terms") govern your use of www.nibia.ng and the Nibia mobile application and services. By accessing or using our services, you agree to be bound by these Terms.

1. ACCEPTANCE OF TERMS

By creating an account and using Nibia, you acknowledge that you have read, understood, and agree to be bound by these Terms and conditions. If you do not agree to these Terms, please do not use our services.

2. USER ACCOUNTS

2.1 Account Registration

You are expected to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials.

2.2 Account Types

Nibia offers different account types including Family and Business accounts. Each account type may have different features, requirements and Offers.

2.3 Account Security

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

3. SERVICES (SHOP)

3.1 Food Products and Delivery

Nibia provides a platform for ordering mostly foodstuffs products with flexible delivery options including home delivery and pickup.

3.2 Subscription Plans

We offer subscription plans with various durations (1 month, 3 months, 1 year). Subscription terms clearly are specified at the point of purchase.

3.3 Payment Plans

Flexible payment options are available in the pick & mix section of the shop, allowing you to select different items and pay instantly, pay small-small, pay-later or lock prices.

4. AUCTIONS

4.1 Auction Participation

Users may participate in auctions for select products. Bid and win items. Save up-to 90% on the actual cost. You can only bid with nibia points. All bids are binding.

4.2 Winning Bids

Auction winners must complete purchase within the specified timeframe or forfeit their winning bid.

5. ORDERS AND PAYMENTS

5.1 Order Placement

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order if necessary.

5.2 Important Notice About Prices and Quantities

If you do not pay in full, market conditions may affect your order.

For 1-month, 3-month, Pay Small-Small, and Pay Later plans:

  • Item quantities stay the same.
  • Only prices may change.
  • If prices go up, you will pay the extra amount at your final payment.
  • If prices go down, you will pay less at your final payment.

For the 1-year plan:

Market conditions may affect both prices and item quantities.

  • You can choose to Top Up: Pay the extra amount and receive all items, or
  • Close Invoice: Receive items worth the total amount you have paid.

Note: Market conditions mean prices can go up or down.

6. PRICING

All prices are displayed in Nigerian Naira (NGN) and are subject to change without notice. The price charged will be the price displayed at the time of order placement. The final payment for orders on installments is subject to market prices.

6.1 Payment Methods

We accept various payment methods (Direct bank Transfer, Food money, Nibia or Foodmoney + Nibia) as displayed in the app. Payment is due according to your selected payment method.

6.2 Failed Payments

If a scheduled payment fails, we will notify you and may suspend your account until payment is resolved.

7. DELIVERY

7.1 Delivery Areas

We deliver to specified areas within our service zones using independent riders in our riders network and GIG logistics. Delivery fees vary by location.

7.2 Delivery Times

While we strive to deliver according to scheduled dates, actual delivery times may vary due to circumstances beyond our control.

7.3 Delivery Issues

You must inspect products upon delivery. Report any issues within 6 hours immediately after collection.

8. CANCELLATIONS AND RETURNS

8.1 Order Cancellation

You may only edit orders being processed after full payment within a stipulated window. Subscription cancellations attract cancellation fees subject to terms specified in your subscription agreement.

8.2 Returns and replacements

Orders may be returned and replaced within 24 hours if there is a quality issue. Contact support to initiate a return and replace.

9. NIBIA REWARDS

9.1 Earning Rewards

  • You earn nibia points as purchase Rewards for shopping.
  • You earn nibia points as Commissions for your referral’s purchases
  • You earn nibia points for participating in exclusive programs.

9.2 Redemption

Nibia points are redeemed for discounts on future purchases according to the current redemption rate. 1Nibia = 1 Naira as of today.

9.3 Expiration

Nibia points do not expire according to our rewards program terms.

9.4 - What are Nibia Points (Ň- Nibia)

The Nibia point System is an Advertising and marketing funding program by the Management of Nibiago Limited designed to incentivise shopping in the Nibia App.

The Nibia point is specifically designed for use only within the Nibia ecosystem and can only be redeemed for food and related products or services ensuring that Nibia’s resources and incentives are aligned with part of her mission to flatten the food inflation curve and redistribute wealth across the food-value chain.

Users may earn additional Nibia points (Nibia) as incentives for engaging in other specific activities promoted by Nibia within the ecosystem. These points are stored in a dedicated spot within the user’s account on the Nibia App.

The Management reserves the exclusive right to adjust, suspend or end the points earned by users in the future.

Important Note / Disclaimer: Nibia points though in a digital form are distinct from digital and crypto currencies and so should not be referred to as one.

10. AFFILIATE PROGRAM

10.1 Standard Account

Earns 0.4% to 2.5% on the first 3 purchases made by each user referred.

10.2 Growth Associate (GA)

Earns 0.4% to 2.5% on every purchase made by each user referred for life. Can withdraw nibia points as cash. Lifetime passive income.

NB: Only 30 people in each city can reach the GA status.

10.3 Growth Elite (GE)

High-performing Growth Associates may qualify for Growth Elite status with enhanced benefits. Profit sharing up-to 0.2% of the city’s annual revenue.

NB: Only 5 people in each city can reach the GE status.

10.4 Affiliate Program Terms

Participation in nibia’s referral program is subject to terms and eligibility requirements.

11. CHARGES

Membership in nibia is free. Nibia does not charge any fee for browsing and buying on the nibia App.

However, nibia reserves the right to charge a fee and change its policies from time to time. In particular, nibia may at its sole discretion introduce new services and modify some or all of the existing services offered on the nibia App. In such an event Nibia reserves, without notice to You, the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee and related policies shall automatically become effective immediately once implemented on the nibia App. Unless otherwise stated, all fees shall be quoted in Nigerian Naira. You shall be solely responsible for compliance of all applicable laws including those in Nigeria for making payments to nibia.

12. TERMINATION OF SERVICE

Nibia reserves the absolute right to modify, discontinue, temporarily or permanently, any and all portions of our goods and services with or without prior communications. You hereby consent that nibia will under no circumstance be liable to you or any third party for any modification or discontinuance of availability of goods or services on the nibia App.

13. TRADEMARK, COPYRIGHT & RESTRICTION

www.nibia.ng and Nibia App is controlled and operated by Nibiago Limited. All material on this site and App, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights that are owned and controlled by us or by other parties that have licensed their material to us. Material on nibia website owned, operated, licensed or controlled by us is solely for your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by e-mail or other electronic means and whether directly or indirectly and you must not assist any other person to do so. Without the prior written consent of the owner, modification of the materials, use of the materials on any other web site or networked computer environment or use of the materials for any purpose other than personal, noncommercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited. Any use for which you receive any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause.

14. COPYRIGHT COMPLAINT

We at Nibia respect the intellectual property of others. In case you feel that your work has been copied in a way that constitutes copyright infringement you can write to us at support@nibia.ng

15. RISK OF LOSS

All items purchased from the nibia App are made pursuant to a shipment contract. This means that the Risk of Loss shall remain with Nibia until the item is transferred to You. In the event that the items are damaged after receipt, the risk falls on the customer.

16. INTELLECTUAL PROPERTY

All content, trademarks, and intellectual property on the Nibia platform are owned by Nibia or our licensors. You may not use, copy, or distribute our content without permission.

17. USER CONDUCT

You agree not to:

  • Use the service for any illegal purpose
  • Violate any laws or regulations
  • Interfere with or disrupt the service
  • Attempt to gain unauthorized access to our systems
  • Harass, abuse, or harm other users
  • Post false or misleading information

18. PRIVACY

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

19. DISCLAIMERS

19.1 Service Availability

We do not guarantee uninterrupted or error-free service. The service is provided "as is" without warranties of any kind.

19.2 Product Quality

While we strive to provide high-quality products, we do not guarantee that products will meet your expectations all the time. If and when it does, the return policy covers you.

20. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Nibia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

21. INDEMNIFICATION

You agree to indemnify and hold Nibia harmless from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

22. MODIFICATIONS

We reserve the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the modified Terms.

23. TERMINATION

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion.

24. GOVERNING LAW

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the courts of Nigeria.

26. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By using Nibia, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
